The High Commissioner to combat counterfeiting and piracy
is a governmental agency created at the end of 2005 (Law May 14th 2005, n. 80, and Law March 11th 2006, n. 8.).

The High Commissioner can be considered an innovative figure both in the national and in the international panorama. Indeed, it has been thought by the Italian Parliament and Government as an instrument to foster the integration and the collaboration of all the public institutions dealing with counterfeiting, and also as a mean for the whole private sector to be fully involved as a main actor in this fight. In this framework, the mandate of the High Commissioner laid down by law is:

  • to coordinate all the public institutions concerned with this problem and to create the framework for a fruitful collaboration among them;
  • to monitor the phenomenon and to review the performances of the public institutions;
  • to elaborate a national strategy and put forward proposals to reform legislation and regulation;
  • to assist the enterprises victim of counterfeiting.

As far as the coordination of public institutions is concerned, it must be remembered that in Italy there are 17 public bodies which have jurisdiction in fighting counterfeiting and piracy: police forces, custom agency, Ministries, Judiciary. Competencies are dispersed among these autonomous bodies, all dealing independently with the same matter. In this difficult situation, the function of the High Commissioner is precisely to give account to the varied competencies of all these bodies and to find a way to coordinate all their initiatives and efforts towards the achievement of common goals and objectives.

The another function is the monitoring of the phenomenon and the review of the performances of the other national public institutions. In this sense the High Commissioner has created a database containing all the data on counterfeiting in Italy. What is being done is: to collect all the data available on seizures and legal proceedings from the different Italian police forces, to standardize them according to some set criteria, and finally to analyse them. This proceeding will eventually allow us to have a comprehensive and clear picture of the situation of counterfeiting in Italy. What we are hoping is that its analysis will help us to identify the major criticalities of this phenomenon in our country and to develop adequate countermeasures.

At present, the review and improvement of the anti-counterfeiting legislation and regulation is one of the functions where the High Commissioner is placing major efforts. On September 8th 2006 the Italian Prime Minister Romano Prodi, appoints H.H. Giovanni Kessler as High Commissioner to combat counterfeiting and piracy.
